Terms of Service
The rules of using Tipsy Chat, set out in short points you can actually read.
1.
Agreement
By using Tipsy Chat you accept these terms. If you do not accept them, please do not use the service.
2.
Eligibility
You must be at least 18 years old and legally able to enter into a contract in your jurisdiction.
3.
The service
Tipsy Chat provides conversation with fictional companion characters through a web interface.
4.
Fictional characters
Every companion on Tipsy Chat is invented. Names, biographies, photographs and locations are creative works and do not depict real individuals.
5.
Not professional advice
Nothing a companion says is medical, legal, financial or psychological advice. Consult a qualified professional for those matters.
6.
Emergencies
Tipsy Chat is not a crisis service. If you are in danger or in crisis, contact your local emergency number or a recognised helpline immediately.
7.
Your account
You are responsible for the security of your access credentials and for activity that takes place through them.
8.
Acceptable use
Do not use Tipsy Chat to harass others, to break the law, or to attempt to generate unlawful material of any kind.
9.
Prohibited technical conduct
Scraping, automated access, reverse engineering, load testing and attempts to bypass access controls are not permitted.
10.
Content you submit
You keep ownership of what you write. You grant us a limited licence to process it in order to operate the service.
11.
Our content
The Tipsy Chat name, design, character writing, imagery and code are protected. Do not copy or republish them without written permission.
12.
Companion output
Automatically generated replies may be inaccurate, inconsistent or unintentionally strange. Treat them as fiction, not as fact.
13.
No guarantee of continuity
Characters may be revised, renamed, retired or replaced as the cast develops.
14.
Availability
We aim for continuous availability but do not guarantee it. Maintenance, outages and third-party failures happen.
15.
Free and paid access
Some features may be free and others paid. Prices, limits and inclusions are shown before any purchase.
16.
Billing
Where a paid plan exists, charges are taken through our payment provider on the cycle shown at checkout.
17.
Renewals
Subscriptions renew automatically until cancelled. Cancellation stops the next renewal and does not shorten the current period.
18.
Refunds
Refunds are handled according to the policy in force at the time of purchase and any rights granted to you by consumer law.
19.
Third-party services
Payment, hosting and analytics are provided by third parties operating under their own terms.
20.
Privacy
Use of Tipsy Chat is also governed by our Privacy Policy, which forms part of this agreement.
21.
Suspension
We may suspend or close access where these terms are broken or where required to protect the service or other users.
22.
Termination by you
You can stop using Tipsy Chat at any time and request deletion of your data.
23.
Disclaimer of warranties
The service is provided “as is” and “as available”, without warranties of any kind to the extent permitted by law.
24.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential losses arising from use of the service.
25.
Liability cap
Where liability cannot be excluded, it is limited to the amount you paid to Tipsy Chat in the twelve months before the claim arose.
26.
Indemnity
You agree to cover losses we suffer as a result of your misuse of the service or breach of these terms.
27.
Force majeure
Neither party is liable for failures caused by events outside its reasonable control.
28.
Changes to the service
Features may be added, altered or withdrawn as the product develops.
29.
Changes to these terms
Updated terms are published on this page with a revision date. Continued use means acceptance.
30.
Severability
If a clause is held unenforceable, the rest of these terms remain in force.
31.
No waiver
A delay in enforcing a right is not a waiver of that right.
32.
Assignment
You may not transfer your rights under these terms. We may transfer ours as part of a business reorganisation.
33.
Governing law
These terms are governed by the laws applicable at our place of establishment, without regard to conflict of law rules.
34.
Entire agreement
These terms and the Privacy Policy make up the whole agreement between you and Tipsy Chat.
